Fee Waiver
In most cases, you have to pay a fee to file papers with the court.  The fees vary by county.

If you do not earn enough money, the court can decide that you do not have to pay the fees.  
This is called a “fee waiver”.

To find out if you qualify for a fee waiver, look at form FW-001-INFO Information Sheet on
Waiver of Court Fees and Costs.

You need 2 forms to ask for a fee waiver.  All forms can be found on the California Courts web
site.  Go to
www.courtinfo.ca.gov or click on the links below.










ALERT:  The California Court has recently changed the forms and procedure for
obtaining a fee waiver.  You can still use the forms linked above, however, the
instructions below have changed.  Please bear with us while we update this page.

Now go to Form FW-001:

Fill in the top portion of the form.  This section contains your name and address, the
name and address of the court, and the names of the parties involved in the case.
Answer questions 1 through 3.
Look at the Information Sheet on Waiver of Court Fees and Costs. There are 3 ways to
qualify for a fee waiver:

1.  If you are receiving financial assistance under one or more of the programs listed in
Item 1 on the Information Sheet, proceed this way:

Check Item 4 and then check a, b, c or d.
Under Item 5, check and complete one of the three boxes, either a, b, or c.  Do not
check more than one box.
Skip items 6 and 7.
At the bottom of the page, fill in the date, print or type your name and sign your name.
You do not have to fill out Page 2.

2.  If you are not receiving financial assistance, but your total gross monthly household  
income is less than the amount shown in Item 2 on the Information Sheet, proceed this
way:

Check Item 6.
Skip Item 7.
At the bottom of the page, fill in the date, print or type your name and sign your name.
On Page 2, fill in the names of the parties at the top and complete items 8, 9a, 9d, 9f,
and 9g.

3.  If you do not qualify under Items 1 or 2 on the Information Sheet, but your income is
not enough to pay for the common necessities of life for yourself and the people you
support and also pay court fees and costs, proceed this way:

Check Item 7.
At the bottom of the page, fill in the date, print or type your name and sign your name.
On Page 2, fill in the names of the parties at the top and complete Items 8 through 12.

Now go to Form FW-003:

Fill in the top portion of the form with your name and address, the name and address of
the court, and the names of the parties involved in the case..  
Complete Item 1 by filling in the date you are filing your paperwork with the court.  If a
previous fee waiver was issued, check the box and fill in the date of the previous order.
Complete Item 2 by filling in your name.
Leave the rest of the form blank.
Submit your completed fee waiver forms to the court clerk when you file your other
court forms.

Note:  The Fee Waiver forms are confidential forms for the court only.  Do not serve them on
the other party in your case.
